Emporiant Affiliate Program Bedingungen

Diese Bedingungen regeln Ihre Teilnahme am Emporiant Affiliate-Programm (das „Programm“). Mit Ihrer Anmeldung erklären Sie sich mit diesen Bedingungen einverstanden.

1. Allgemeine Vereinbarung

Emporiant.com (im Folgenden „Emporiant“, „Wir“, „Unser“) betreibt ein Affiliate-Programm, das es Affiliates ermöglicht, Provisionen durch Empfehlungen zu verdienen. Dieser Vertrag legt die Beziehung zwischen Emporiant und den Affiliates fest.

2. Definitionen

  • Affiliate: Jede Person, die sich zur Teilnahme anmeldet und Emporiants Dienstleistungen durch Weiterempfehlungen bewirbt.
  • Provision: Eine variable Vergütung, die auf Basis der durch eine Empfehlung erzielten Umsätze berechnet wird.
  • Tracking-Cookie: Ein Cookie, das 30 Tage lang die Empfehlungen der Affiliates registriert.

3. Berechtigung

Zur Teilnahme am Programm sind nur Personen berechtigt, die:

  • Mindestens 18 Jahre alt sind.
  • In einem Land wohnen, das Affiliate-Marketing-Verträge erlaubt.
  • Gültige Informationen während des Anmeldeprozesses angeben.

4. Registrierung

Zur Teilnahme am Programm müssen Sie sich bei Emporiant.com registrieren und folgende Angaben machen:

  • Name
  • Kontaktinformationen
  • Zahlungsdetails

Nach der Registrierung erhalten Sie einen einzigartigen Affiliate-Link zur Verfolgung von Empfehlungen.

5. Affiliate-Provisionen

  • Provisionsmodell:
    • Erster Projektabschluss: 10 % des Projektwertes.
    • Reduktion um 2,5 % pro weiterem Projekt, bis die Provision 2,5 % erreicht. Ab diesem Punkt bleibt die Provision fix.
  • Anwendbarkeit: Die Provision gilt für alle Dienstleistungen von Emporiant.
  • Mindestbetrag zur Auszahlung: 75 EUR.

6. Tracking und Cookie-Dauer

  • Emporiant verwendet ein internes Link-System zur Verfolgung von Empfehlungen.
  • Die Tracking-Cookies sind 30 Tage gültig.

7. Verpflichtungen der Affiliates

Affiliates verpflichten sich:

  1. Ethisches Marketing: Keine Spam-Praktiken oder irreführende Werbung einzusetzen.
  2. Aktuelle Materialien: Emporiants bereitgestellte Marketingmaterialien zu verwenden.
  3. Compliance: Den Verbraucherschutz- und Datenschutzgesetzen, insbesondere der DSGVO, zu entsprechen.
  4. Transparenz: Offenzulegen, dass sie eine Provision erhalten.

Verstöße gegen diese Verpflichtungen können zum Ausschluss aus dem Programm führen.

8. Datenschutz

  • Affiliates müssen die Vertraulichkeit von Kundendaten und Programminformationen wahren.
  • Jede Weitergabe von personenbezogenen Daten ohne Genehmigung durch Emporiant ist untersagt.

9. Zahlungsbedingungen

  • Auszahlungen erfolgen monatlich, sofern der Mindestbetrag von 75 EUR erreicht wird.
  • Verfügbare Zahlungsmethoden: Banküberweisung, PayPal.
  • Affiliates sind für ihre eigenen Steuerverpflichtungen verantwortlich.

10. Beendigung der Teilnahme

  • Beide Parteien können den Vertrag jederzeit mit einer Frist von 30 Tagen kündigen.
  • Im Falle von Vertragsbrüchen kann Emporiant die Teilnahme sofort beenden.
  • Nach der Kündigung dürfen Affiliates Emporiants Materialien nicht weiter verwenden.

11. Haftungsbeschränkung

  • Emporiant übernimmt keine Haftung für Verluste oder Schäden, die durch unethisches Verhalten der Affiliates entstehen.
  • Unsere maximale Haftung ist auf die in den letzten 12 Monaten verdienten Provisionen beschränkt.

12. Änderungen der Bedingungen

Emporiant behält sich das Recht vor, die Bedingungen jederzeit zu ändern. Affiliates werden darüber informiert. Die weitere Teilnahme am Programm gilt als Zustimmung zu den geänderten Bedingungen.

Emporiant Affiliate Program Terms and Conditions

These terms govern your participation in the Emporiant Affiliate Program (the “Program”). By registering, you agree to these terms.

1. General Agreement

Emporiant.com (hereinafter “Emporiant,” “We,” “Our”) operates an affiliate program that allows affiliates to earn commissions through referrals. This agreement defines the relationship between Emporiant and the affiliates.

2. Definitions

Affiliate: Any individual who registers to participate and promotes Emporiant’s services through referrals.
Commission: A variable compensation based on the revenue generated from a referral.
Tracking Cookie: A cookie that tracks affiliate referrals for 30 days.

3. Eligibility

To participate in the Program, individuals must:

  • Be at least 18 years old.
  • Reside in a country where affiliate marketing contracts are allowed.
  • Provide valid information during the registration process.

4. Registration

To join the Program, you must register on Emporiant.com and provide the following details:

  • Name
  • Contact information
  • Payment details

Upon registration, you will receive a unique affiliate link to track referrals.

5. Affiliate Commissions

Commission Model:

  • First project completion: 10% of the project value.
  • Reduction of 2.5% per additional project, until the commission reaches 2.5%. From that point, the commission remains fixed.

Applicability: The commission applies to all services provided by Emporiant.

Minimum payout amount: 75 EUR.

6. Tracking and Cookie Duration

Emporiant uses an internal linking system to track referrals.
The tracking cookies are valid for 30 days.

7. Affiliate Obligations

Affiliates agree to:

  • Ethical Marketing: Not to use spam practices or misleading advertising.
  • Use Current Materials: To use marketing materials provided by Emporiant.
  • Compliance: To comply with consumer protection and data protection laws, especially the GDPR.
  • Transparency: To disclose that they receive a commission for their referrals.

Violations of these obligations may lead to removal from the Program.

8. Data Privacy

Affiliates must maintain the confidentiality of customer data and program information.
Any sharing of personal data without Emporiant’s approval is prohibited.

9. Payment Terms

Payouts are made monthly, provided the minimum payout threshold of 75 EUR is reached.
Available payment methods: Bank transfer, PayPal.
Affiliates are responsible for their own tax obligations.

10. Termination of Participation

Both parties may terminate the agreement with a 30-day notice period.
In case of contract breaches, Emporiant may terminate participation immediately.
After termination, affiliates may no longer use Emporiant’s materials.

11. Limitation of Liability

Emporiant is not liable for any losses or damages caused by unethical behavior from affiliates.
Our maximum liability is limited to the commissions earned in the last 12 months.

12. Changes to Terms

Emporiant reserves the right to change the terms at any time. Affiliates will be notified. Continued participation in the Program is considered acceptance of the changes.
