AGB – Terms & Conditions

1. Geltungsbereich
Diese Allgemeinen Geschäftsbedingungen (AGB) gelten für alle Verträge zwischen Emporiant – Anto Markunovic und seinen Kunden im Bereich Filmproduktion, Content Creation, Fotografie, Grafikdesign sowie für die Nutzung der Webseiten und Subdomains von emporiant.com, insbesondere shop.emporiant.com (Webshop), hub.emporiant.com (Forum) und ads.emporiant.com (Partneranzeigen).

2. Vertragsabschluss
Ein Vertrag kommt durch schriftliche Bestätigung eines Angebots oder durch Unterzeichnung eines Werkvertrags zustande.

3. Leistungen
Der Umfang der Leistungen ergibt sich aus dem jeweiligen Angebot. Änderungen bedürfen der schriftlichen Vereinbarung.

4. Preise und Zahlungsbedingungen
Alle Preise verstehen sich netto, zuzüglich der gesetzlichen Mehrwertsteuer. 50% des Honorars sind bei Auftragserteilung fällig, der Rest bei Lieferung des Endprodukts.

5. Urheberrechte
Alle von Emporiant erstellten Werke bleiben bis zur vollständigen Bezahlung Eigentum von Emporiant. Der Kunde erhält nach vollständiger Zahlung das einfache Nutzungsrecht für den vereinbarten Zweck.

6. Haftung und Verantwortlichkeit für Subdomains

6.1 Forum (hub.emporiant.com)
Emporiant und Anto Markunovic übernehmen keine Haftung für Inhalte, die von Nutzern im Forum hochgeladen, veröffentlicht oder geteilt werden. Trotz Kontrolle und Moderation der Inhalte liegt die rechtliche Verantwortung für hochgeladene Inhalte ausschließlich bei den jeweiligen Nutzern. Emporiant behält sich vor, rechtswidrige Inhalte zu entfernen und Nutzer zu sperren, übernimmt jedoch keine Garantie für die Rechtmäßigkeit oder Sicherheit der Inhalte.

6.2 Webshop (shop.emporiant.com)
Für Produkte, Dienstleistungen und Transaktionen im Webshop gelten die hier aufgeführten AGB sowie gegebenenfalls zusätzliche Nutzungsbedingungen der eingesetzten Shop-Software. Emporiant übernimmt keine Haftung für technische Störungen, Lieferverzögerungen oder sonstige Probleme, die durch Drittanbieter oder Zahlungssysteme verursacht werden.

6.3 Partneranzeigen (ads.emporiant.com)
Die Inhalte und Werbeanzeigen auf der Plattform ads.emporiant.com stammen von Dritten (Partnern). Emporiant übernimmt keinerlei Haftung für die Richtigkeit, Rechtmäßigkeit oder Qualität dieser Inhalte. Die Nutzung erfolgt auf eigenes Risiko der Besucher.

6.4 markunovica.emporiant.com – unsere Portfolioseite für Fotografie, betrieben auf einem einfachen WordPress-System. Hier werden technisch notwendige Cookies gesetzt und Zugriffsstatistiken (z. B. durch Jetpack oder ähnliche Analysewerkzeuge von Automattic Inc.) verarbeitet, um die Seite technisch stabil zu betreiben.

6.5 academy.emporiant.com – unsere Lernplattform für Schulungen, betrieben mit LifterLMS, einem E-Learning-System der LifterLMS, Inc., 1317 Edgewater Dr #4647, Orlando, FL 32804, USA. Dort werden Nutzerdaten wie Name, E-Mail, Fortschritt im Kurs, IP-Adresse und Login-Zeitpunkte verarbeitet, um den Lernfortschritt zu speichern, Nutzerkonten zu verwalten und eine personalisierte Lernerfahrung zu ermöglichen. 6.6 Allgemeine Haftungsausschlüsse
Emporiant haftet nur für Schäden, die vorsätzlich oder grob fahrlässig verursacht wurden. Für Datenverluste, entgangenen Gewinn oder Schäden durch höhere Gewalt wird keine Haftung übernommen.

7. Stornierung
Bei Stornierung eines Auftrags durch den Kunden werden folgende Stornogebühren fällig:

Bis 14 Tage vor Produktionsbeginn: 25% des Honorars
Bis 7 Tage vor Produktionsbeginn: 50% des Honorars
Weniger als 7 Tage vor Produktionsbeginn: 100% des Honorars

8. Schlussbestimmungen
Es gilt österreichisches Recht. Gerichtsstand ist Graz. Sollten einzelne Bestimmungen dieser AGB unwirksam sein, bleibt die Wirksamkeit der übrigen Bestimmungen unberührt.

These Terms & Conditions apply to all contracts between Emporiant – Anto Markunovic and its clients in the areas of film production, content creation, photography, graphic design, as well as the use of the websites and subdomains of emporiant.com, in particular shop.emporiant.com (webshop), hub.emporiant.com (forum) and ads.emporiant.com (partner advertisements).

2. Conclusion of Contract
A contract is formed through written confirmation of an offer or by signing a production agreement.

3. Services
The scope of services is defined in the respective offer. Changes must be made in writing.

4. Prices and Payment Terms
All prices are net, plus statutory VAT. 50% of the fee is due upon commissioning, the remaining 50% upon delivery of the final product.

5. Copyrights
All works created by Emporiant remain the property of Emporiant until full payment is made. Upon full payment, the client receives a non-exclusive usage right for the agreed purpose.

6. Liability and Responsibility for Subdomains

6.1 Forum (hub.emporiant.com)
Emporiant and Anto Markunovic assume no liability for content uploaded, posted, or shared by users in the forum. Despite content control and moderation, legal responsibility for uploaded content lies solely with the respective users. Emporiant reserves the right to remove illegal content and block users but provides no guarantee for the legality or safety of content.

6.2 Webshop (shop.emporiant.com)
Products, services, and transactions in the webshop are subject to these Terms & Conditions as well as any additional terms of the shop software used. Emporiant assumes no liability for technical malfunctions, delivery delays, or other issues caused by third parties or payment systems.

6.3 Partner Advertisements (ads.emporiant.com)
Content and advertisements on ads.emporiant.com originate from third parties (partners). Emporiant assumes no liability for the accuracy, legality, or quality of this content. Use is at the visitor’s own risk.

6.4 markunovica.emporiant.com – our photography portfolio site, operated using a basic WordPress setup. Essential cookies and access statistics (e.g., via Jetpack or similar analytics tools from Automattic Inc.) are used to ensure technical stability of the site.

6.5 academy.emporiant.com – our learning platform for courses and training, powered by LifterLMS, an e-learning system by LifterLMS, Inc., 1317 Edgewater Dr #4647, Orlando, FL 32804, USA. Personal data such as name, email, course progress, IP address, and login times are processed to manage user accounts, store progress, and provide a personalized learning experience. 6.6 General Liability Exclusions
Emporiant is liable only for damages caused intentionally or by gross negligence. No liability is assumed for data loss, lost profits, or damages caused by force majeure.

7. Cancellation Policy
If a project is cancelled by the client, the following cancellation fees apply:

Up to 14 days before production: 25% of the fee
Up to 7 days before production: 50% of the fee
Less than 7 days before production: 100% of the fee

8. Final Provisions
Austrian law applies. Place of jurisdiction is Graz. If individual provisions of these Terms & Conditions are invalid, the validity of the remaining provisions remains unaffected.
